    Re: Bailiff problem

Your 'get out of jail card' according to the regulations is whether you acquired the vehicle in the following circumstances:

    In 'good faith'

    and:

    For 'valuable consideration'.

PS: Your 'claim' as suggested by Bluebottle should be sent by email (for speed) and needs to be sent to the local authority and COPIED to the bailiff firm. Depending on your responses to my above post it is possible that it may require amending.

I am also sorry to be the bearer of bad news by telling you that you could indeed have a problem and this because of the statutory regulations impose a clause that goods belonging to the debtor become 'bound' from a certain date and that the debtor cannot therefore dispose of an asset (in this case a motor vehicle).

        First things first....

        Which company is this?

What documentation was left with you?

How much is the bailiff demanding?

How much is your car worth (roughly)?

Did you purchase the vehicle from a relative or close friend (maybe an odd question but there is a reason for asking)?

How much was the purchase price?

Are you able to contact the previous owner?

Have you done so....and what is their response?

If the previous owner had not been aware of this PCN then they should file an Out of Time witness statement TODAY.

        Onesource bailiffs
they left a four page letter
        £1600 (approx)
        £450
        previous keeper is not contactable

i have contacted romford police and spoke to a Sargent who said "the car has not been stolen so i cant take a stolen car report"
he said its a civil matter and i should get a solicitor but i cant afford one. He said the police can not get involved

Does the letter contain a lot of waffle and BS. When bailiff companies send letters exceeding two pages, penny to a pound, they have been caught with their pants down and hope you swallow their waffle and BS and leave them alone.

Have you contacted the local authority who contracted One Source yet?

Could you respond to let us know what the four page letter is. What is it entitled?

Can you provide a breakdown of the fees ( I would expect to see a removal fee of £110 but I am worried that storage fees are being incurred as well). Does the document outline the fees?

How much did you pay for the car?

Also, is the car insured in your name and when did the insurance start?

Was the car advertised for sale or did you know the previous owner?

The above questions will be asked by the local authority.

              Re: Bailiff problem

I rang havering council and they said its in the hands of the bailiffs and i must deal with them direct.

I bought car for £450 from a friend of a friend and she has moved back to ireland.

The letter is an inventory. £517. And £48 per day storage

                Re: Bailiff problem

I just want to thank everyone that helped me i am very grateful.

I spoke to bailiff company and he was very rude and told me to "pay or you lose your car".

I now feel my only option is to take them to the small claims court.

I will let you know how it all ends up. Thanks again
