  • Parking Eye PCN - advice please!

    I'm in receipt of a PCN from Parking Eye relating to an overstay and am not sure whether I should respond or ignore.
    I've read lots if different stuff around this, but the more I read, the more confused I get!
    Can anyone give me advice on the best course of action?

    Much of the ignore advice you see is old and very much out of date (except in Scotland).

    You should appeal to parking eye and if you lose to popla such as this.

    Examples of appeals to parking eye that i suggest are

    Dear Sirs,

    I, as registered keeper, wish to invoke your appeals procedure. The driver did not see signs, or indeed car park markings.In any event your charges are penal and not a genuine pre estimate of loss. I am under no statutory duty to name the driver and will not do so.

    Should you reject my appeal please supply a popla code.

    Yours etc


    Dear Sirs,

    I, as registered keeper, wish to invoke your appeals process. The driver was a genuine customer and i attach copies of receipts to show this. I spoke with x at The Range who agreed that this would see the charge cancelled.

    Your charges are also penal and not a genuine pre estimate of loss. Should you reject my appeal please provide a popla code.

    I am under no statutory obligation to name the driver and will not do so.

    Yours etc


    Note that some basics are the same but other parts are based on circumstances. Make your own to suit but keep in the obvious parts.

      Thanks for your quick response. I think your first suggested wording will suit best, as I can't provide any receipts for the supermarket car park that I was parked in, but can provide them for the neighbouring stores.
      Do you happen to know what the chances are of them issuing court proceedings? I've read that these are few and even when they do issue, they've never won a case.

          They issued 13000 court claims orso last year so they do do court. An appeal followed by a good popla appeal currently has a near perfect record. Overall popla is about 60% but that includes people who don't know the magic wording for their appeals.

                  Hi there,

                  Well, I've had a response from PE, in fact I've had 2 letters, both posted on the same day in separate envelopes, what a waste of PCN payers' money!

                  One of the letters quotes lots of case law whereby PE have won cases, etc., saying that their charges are not penal etc etc. Whilst it's clear that they haven't read my appeal letter properly (they stated that I'd refused to provide the driver details, which is factually incorrect - I merely said that I wasn't going to provide details), I'm finding the tone of the letter quite intimidating.

                  They haven't technically declined my appeal, just said that it's been deferred - not sure what that means. They also haven't provided me with a POPLA code - are these standard type letters? Should I be concerned?

                    Parking eye spew so crap that if you wrote and asked Rachel out on a date you get'd a novel on why the company charges are appropriate and Rachel would neither refuse nor accept a date with you. They'll never ever accept the charges are crap or a £54 000 000 business bites the dust.

                    Are they asking you for info or is it just wind and piss ?

                      Lol, that brought a smile to my face!
                      One of the 2 letters (not the caselaw one) says that the Charge has been put on hold for me to provide additional/further evidence, but they haven't said exactly what that should be...? Alternatively, they are giving me another opportunity to pay, which won't happen without a fight.

                        In that case write back and state you have no further evidence to give and if the appeal is denied they should send a popla code.

                          Great, will do . I'm a tad concerned as I didn't actually go into the supermarket in question, but did use the surrounding shops (and spent £100+). I genuinely did not see the signs, nor did I realise that I'd driven into the wrong part of the car park (they are next to each other). Not much of a defence as far as they're concerned I guess, but that is the truth.
