Firstly, this is my first post, so thank you in advance for your help, I have already found some very useful information and templates on this site, hence my decision to join.
I am writing in relation to 3 x PCN given to my partner following parking at our Local Hospital (South Wales). This is private, not council land and was given by VINCI PARK UK LTD and now followed up by ROXBURGHE.
BACKGROUND: The parking charges occured in July, during this time my partner was working at the hospital, she was working her notice as she was leaving to relocate within the UK. Weeks prior to the charge occuring she had had a car accident and the vechile was a write off. She bought a new car but had not got a new parking permit from the hospital as it would take longer to get a new one than she would be at the hosptial, as recomended by her Manger. She did continue to pay the staff parking rate at the hosptial and parked in the staff car parks.
Whilst working nights she recieved 3 x PCNs over consecutive days, although she doesn't have copies of the staff parking ticket she paid for, nor did she recieve the PCNs at the time. Since, she has been written to by Roxburghe as the registered keeper of the car stating that she is liable. Intitally we did some research into what to do and found most advice pointed to doing nothing, indeed that is what her collegues had done in similar situations.
However, having found more recent advice, we responded using the template letter found at the 'Parking Cowboys' website. Roxburghe have now replied stating that their charge 3 x £84 is valid and also that if we don't pay they will take the matter futher and that costs could be greater. I am about to reply to this letter with an appeal, as per the template on here that is used for the POPLA appeals process, changed to suit our individual case. I fully expect them to reply in the negative and with the POPLA Code, I will then appeal to POPLA using the same template from here.
What I am writing to ask is two-fold:
1) Do you believe we are doing the right thing by appealing?
2) Can they really increase the charges brought against us should this go to court?
Thank you very much indeed for your support in this matter.
Regards,
E
