I've just had a "Parking Enforcement Notice" from these lovely people demanding £150 (or £75 if I cough up in 14 days).

Fortunately they haven't got a leg to stand on as the notice arrived over 14 days after the alleged infringement.

So- what to do now. I think I have three options:

1- Ignore it, wait for the inevitable threatening letters and then enjoy throwing it back at them when I let them know they haven't stuck to the rules
2- Go to Trading Standards and get them to look into the company sending illegal demands to motorists
3- Go to the independent appeals people (POPLA) and get them to throw the book at them

What to do...?

Thanks - in that case, do as per the advice in the link, either just ignore, or preferably appeal and then ignore as it costs them money then.

Hi,

I recently got a parking charge notice from CEL also. For this period i didn't even get out of my car, I was waiting in the area for 25 mins as there were no available spaces to park whatsoever and following a failed attempt at parking moved swiftly on. CEL have now attempted to charge me £75 in 14 days or £150 in 28 days for the pleasure of not being able to find a space in their carpark.

Do you advise me to do the same thing and write them this letter? This is the first time i've really appealed or repudiated something like this so am quite nervous in doing so as I'm not exactly sure of my rights, but I really don't feel as though i should be paying £75 to these people when I couldn't even park there if i wanted to!

I found a template for an appeal on another post, what do you think should i send it?

Dear Scammers,

In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this appeal the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

The keeper has nothing further to add and refuses to enter into your protracted appeals, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

The appeal will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

Hi everyone,

I received one of these yesterday stating that I overstayed at a cooperative supermarket by 29 minutes. This I did do but I didn't park there until 5pm and the store closes at 4pm (Sunday) the entire car park was deserted.

Should I just ignore this? I've noticed a few threads scattered around the net recently where Civil Enforcement Ltd have actually taken people to court.

I think they'd have a problem establishing loss of earnings when the store wasn't even open however morally I suppose staying at a car park when you're not spending any money there might be a dubious in court (for the record I was having a meal out)

Any advise would be greatly appreciated.

The site's advice is to appeal the decision so it costs the PPC £27+VAT and then ignore anything further should / when your appeal fails. If you are one of the very small minority who ends up receiving a summons you MUST defend it or they will get a default judgment.

To cut a long story short I too have recently received a Parking Charge Notice from Civil Enforcements Ltd for parking longer than the maximum allowed time. The offence was dated 22/09/13 and the PCN issue date is 14/10/13. november charlie (above) seems pretty confident that the notice must be served within 14 days of the offence otherwise Civil Enforcements Ltd would not have a leg to stand on - is this correct ? I am going to send the appeal letter regardless but reassurance that I won't have to pay the charge based on the above would be greatly appreciated. To make matters worse if I do have to pay this charge then I will have to pay twice as my wife and kids met me at the car park and she also received a PCN !!! Thanks in advance

4) The notice must be given by:(a) handing it to the keeper, or leaving it at a current
address for service for the keeper, within the
relevant period; or
(b) sending it by post to a current address for service
for the keeper so that it is delivered to that
address within the relevant period.
(5) The relevant period for the purposes of sub-paragraph
(4) is the period of 14 days beginning with the day after
that on which the specified period of parking ended.

The excerpt above may be in the BPA code of practise but is an extract from POFA and therefore is a legal requirement not just a code of conduct. Do not tell them the driver.

Respond and tell them that you will not be paying as they have not complied with the requirements of POFA.

Of course they can still go to court either because they are stupid/stubborn or because they think they know the driver. This is tempered by the fact they seldom get as far as actually appearing in court but none the less they do like to issue claims.

Appealing then winning at popla is still the best way forward. The above would be part of a popla appeal.

Hi can anyone help me too, I was in Watford in a car park, had no change and was waiting for a friend son to get off the train across the road, i was with 2 other children sitting in my car hoping that someone came along that could change my £5. Nobody did, my friends son turned up 19 mins later as the train was late, then 6 days letter i get a Parking Charge Notice through my door for £75 in first 14 days or then £100. I cant believe i never left my car and still this is allowed to happen, Can anyone advise me what to do? Have written for photographic evidence. The company being Civil Enforcement Ltd

Appeal to them, which they will refuse, then appeal to popla such as this and win.
