  • Another Parking Eye Fine

    I know, another parking eye fine, but just wanted to make sure I was ok to ignore them.
    the other week I parked in a holiday inn space which was sign posted that I shouldn't park there (nothing said about fine) there were about 20 other holiday inn spaces for the whole time I was there. Later got a later saying that they are fining me £100 for parking there. I was just wondering if it was ok to ignore the fine. Thanks

      The site advice is to appeal them and then ignore them but if you want to ignore them then that is equally as fine to ignore them.

        Whether you appeal the invoice and then ignore all other threatograms, or just ignore their letters from the start, I believe it would be wise to get evidence of the signs posted just in case they are so foolish as to try to sue. If their signs did not mention any fees for parking, they can hardly claim a contract existed and, as there were numerous other spaces in the car park, they would find it difficult to make out a case for damages arising from your alleged trespass.

          The most current advice is NOT to ignore BPA AoS members 'parking charges' but to submit a challenge/appeal.

          Ignoring Parking Eye at the moment is a sure fire way to get stamped court papers.

              I've just had a thought re all this relying on there being a contractual relationship established by parking on private land where there are signs stating terms - is it still the case that you have to be over 18 for a contract to be legally binding?

              If that is still so does that mean that 17 year old drivers have no case to answer?

                As such a contract - if one existed - would fall outside the scope of those contracts for which a minor would be liable, then the contract would indeed be voidable. The limited scope of contracts would be those for employment, or for the provision of food, clothing, shelter or housing, and education.

                However, as most car parks of this sort make no charge for parking for a certain period of time, one might use that lack of consideration to dispute that a contract exists.

                  My friend just got a County Court Claim Form, issued by Parking Eye, for parking 15 minutes over time in a free car park with a maximum time limit of 90 minutes, so I would not ignore it.
                  I advised her to ignore it, so I said I would deal with the consequences. Anyone got any suggestions? Should I be starting a new thread?

                        Sorry - just read they've just received the form, not a judgment. They rely on people not defending, so your friend MUST defend. The site pepipoo would give support and advice in this. 99.9% of their successful judgments are those which go undefended so they get a default judgment. Defence is essential, and as long as it is half decent your friend will win.
