I received a letter today from Parking Eye, for an event which happened on the 13th August, and they have issued it to me on the 19th, but I have only received it now.

As per usual, they have said I must pay £100, for parking at a hospital. However, I had parked in the disabled bay's, with my mother in law, who rightly has a Blue Badge issued by the council. I am pretty certain that she is allowed to use that badge for any place in the borough, especially when she was visiting her brother in Royal Free Hospital.

Now as I've just got the letter, I've read through everything and obviously have to make an appeal to ParkingEye first, however I'm not sure what to write, as they can easily just say "Prove that you were using a disabled badge" and even though I can show them in person or via a photo the disabled badge we were using, I don't think it will be adequate enough.

I wanted to ask M1 especially, as I've seen you are an excellent helper here, what shall I initially email Parking Eye and say?

It would be really appreciated if you could guide me through this particular issue, as we legitimately had parked there

I, as registered keeper, wish to invoke your appeals procedure. The driver displayed a blue badge in a disabled bay and saw no signage that this was not allowed. In any event your charges are penal in nature and not a genuine pre estimate of loss.

I am under no statutory obligation to name the driver and will not do so.

Should you reject my appeal please supply a popla code.

ParkingEye have cashed the cheque and I am trying to find out when the deadline is at the moment.
I should explain that I live in China so I don't have the documents to hand but should get the information shortly.

I'd contact PE and enquire as to whether the £60 is considered as full payment or not. If not ask for it back and appeal.

Haven't actually paid the fine yet, just searched the company up on Google and found this awesome thread, and you!

Seems the payment was made before their self imposed deadline so they can swing for the extra!
I am afraid I feel life is too short to get embroiled in a long winded attempt to get the £60 back so will walk away.
Note to self : - Don't park in the UK!

Ha! Your amazing M1! They just replied today and basically told me that the fine has been lifted, and next time to make sure I follow the rules of the car park even though I did...

If they ever mess with me again, your the man to go to!

Very interesting thread....I,ve just received a PCN from parking eye for the tune of £100 for leaving one of their car parks 43 minutes UNDER not over my allotted time.They have obviously requested my details from the DVLA and forwarded this unwarranted pcn....My car was photographed leaving the said car park at 11.39 whilst my tickets clearly states I had until 12.22 to depart.....Should I even entertain this cowboy outfit with an appeal ?

Hi & welcome and the answer is Yes, because they will carry on 'til court.
Appeal to PE, and then when they turn down your appeal, to PoPLA.
Initially use the template (suitably modified) in post 771, and when that's dismissed post 741 for PoPLA (thanks to Mystery:tinysmile_twink_t2

Thanks for the quick response Des8 and I will appeal the pen but my point being and it,s probably because I,m very pedantic why should I waste my time energy and stress levels on a total waste of time.....surely I would be in my rights to charge these chancers for appealing this pcn...I believe they have fraudulently accessed my details with the DVLA,they had no justification in sending this pcn in the first place and most likely chancing their arm with not just me in the hope some people do pay up.

Because it makes it harder for yourself, potentially, if you don't.

Parking will usually cancel at the first stage if sent a scan of the ticket. It's one of the only reasons they do.

I received parking fine of £36 from company called Horizon Parking on 19th November 2013 when i parked on my university car park. My university has an on-line service from where we can book and pay for car parking. Using that system i bought permit for the 19th november 2013 (i still have the permit as a proof) .My only fault is that i didnt display the permit.
Horizon parking issued ticket of £36 when it only costs £8.50 to buy five day permit, so I ignored the ticket. After this I received warning letters from horizon parking which i ignored again. Then company called debt recovery plus ltd sent letter on 05/05/2014 demanding payment of £120. Now on the 02/10/2014, nearly one year after the incident, debt recovery plus have sent me letter titled notice of intended court action and have asked me to pay the amount before 13/10/2014 or they will pass my case to their solicitor.

I dont know what to do. Its too late to appeal to POPLA. Do u think i should just pay the fine? Or ignore and see if they take me to court because even if they do, i have the evidence (parking permit). ALSO, one more important thing: the registered keeper of the car is my husband but i was the driver on that day. All the letters are addressed to my husband but he didnt drive the car on that day.

Either ignore or treat it as a letter before action and respond along the lines of

Dear Horizon parking,

I received your letter headed xxxxx on xxxx the contents of which are noted. It would appear that this is a letter before action although it is not compliant with the pre action protocols.

I deny any debt to Horizon Parking or to Debt recovery plus..

The pre action protocols dictate that in a letter before action the claimant should refer the defendant to the pre action protocol Practice Direction and in particular draw attention to paragraph 4 concerning the court's powers to impose sanctions for failure to comply with the Practice Direction.

The pre action protocols also dictate that in a letter before action the claimant should set out the details of the matter in writing and a clear summary of the facts on which the claim is based.

The claimant should also list the essential documents on which the claimant intends to rely and i would like copies of these please, set out the form of ADR (if any) that the claimant considers the most suitable and invite the defendant to agree to this and refer the defendant to the Practice Direction.

If financial loss is claimed, an explanation of how the amount has been calculated.

Please take this response as an acknowledgement of your LBA to which a full response will be provided within 14 days of rectification of the flaws in your letter. I am taking advice from persons with experience in these matters however that advice is limited until compliance with the above faults is achieved. I would however refer you to Civil Enforcement Limited v Kerry McCafferty. (21/02/2014 Luton County Court) in the mean time.
