Indeed M1, the sticky needs updating (again). Things are moving fairly swiftly in this area.

I would also avoid the use of the word 'Fine' and refer to it as a 'penalty' instead. It may seem trivial, but if you're familiar with what they have to abide by, you'd know why I was saying it. It will show you're on the ball.

While the information is slightly out of date, I would urge you to look at the appeal letter and adapt accordingly. It doesn't allow for your circumstances, per se, so obviously the fact that you paid would link in with point 9 very clearly, and should come right up the top as your first point. Cameras must have seen and got footage of you paying if they are around the car park. Other information can often be obtained via Google earth and street view.

The site www.pepipoo.com is a specialist free motorist site which has some very good examples of successful appeal letters, so it may be worth your while joining there as well - in fact, unless you want their advice, which is usually excellent, you can probably read the appeal letters without joining.

Just had a 6th and final reminder from p eye giving me fourteen days to pay up £100, or they will take me to court.
I have not replied or appealed to any of these demands, but reading other forums it seem`s that they only follow up this threat only if you don`t appeal.
It`s to late to appeal now so, call their bluff or pay up?

That has to be your choice. There is a comprehensive appeal letter here:

                http://www.legalbeagles.info/forums/...rking-Offences

This would give you some ideas for arguments in court. It's probably best to have a read, think about what sort of case you would have, and then make a choice.

If the registered keeper and driver are different people then you're best to name the driver so they cannot pursue the registered keeper and the driver starts at the beginning of the chain and can therefore appeal and end up at popla.

Yep - spot on M1. It's like a game of chess isn't it. Did you get the message about the new stuff on the site? I think it's pretty much the same as you're thinking now anyway.

So i said i would post when it's all over and now it's over, not the result i would have prefered but it's done now, If i had another chance I would have first appealed to PE, even if it was denied at least I would have come out of it with a POPLA number, but instead I ignored all corespondance and the claim got as far as heading down the small claims track, so I caved in and paid them, I have enough stress right now and couldn't handle any more, as it has turned out this case has now been settled out of court for less than the original disounted £55.
I know people will say stupid boy but i took the best financial option for me, after reading threads on here and pepipoo it looks like I would have still been liable for court costs even if the penalty was disregarded or reduced.

The outcome is that the store who's car park it was has now legitably lost revenue because I won't be returning there.

On a final note, this is the reply i got from the store when i e-mailed them for their thoughts

"The Parking Eye camera in the Rheidol Retail Park is not linked with Store Twenty One and we will unfortunately be unable to make a comment on this occasion."
Take that how you please, to me it says either the store does not own the car park in which case where is the revenue loss? or, they are washing their hands of any guilt

                          Hey Funky Gibbon,

Nobody is going to say stupid boy. You have to do what is right for you, only you can decide that, and at least you haven't got the stress of it hanging over you.

It's really interesting and useful to get feedback. What you are saying about having your time again is now reflected in the advice we give as a site. We now recommend appealing and going to Popla as you say. It's difficult as we're always playing catch up with the advice guide as the PPC's change the way they do things.

Out of interest I may send a letter to Store 21 to ask a few questions, as the PPC may not be acting legitimately there, in which case they need calling to account for it.

Anyway, I'm glad you've got it sorted and you're happy and OK - that's all that is important at the end of the day. :beagle:

Thanks Labman, this was my first PCN it's hard to know what to do, I do commend the work members do on this site, it's an invaluable weath of information, I was prepared to apear in court if it came to it, but as it happened the offer came and it took it, still out of pocket but not as much as i could have been.
in the end I cant advise other members what to do, but for anyone else in my situation i say this, dont face PCN's alone, talk to members here, their knowledge is priceless.

Labman PM me if you need specifics, or anyone for that matter

That's actually a very debatable point, depending on where you're parked, signage, land ownership and contracts, etc... It is not as straightforward as some would have you believe.
