    Dear all,

    I received this notice from a private company from the gym I normally park at. They say that I did not register my vehicle in the Gym ( I cannot remember if I did or not, I always do, but there's no ticket or confirmation email you get once you register). Anywho, the date of issue of the letter is at 14 days post incident and I received it 3 days later from that date (17 days). I have already appealed saying yes I was the driver and I do not remember not registering my vehicle at the gym as that would be very unusual and if they have any inside of the gym CCTV to show that I didn't on that day. Waiting to hear back. I was wondering as this ticket was received 17 days after the incident do I have grounds to appeal based on the Protection of Freedoms Act (please see pics attached)

    As you have identified yourself as the driver the parking company no longer has to rely on PoFA2012 (where the 14 day rule applies if the parking company are trying to transfer liability for the charge from the driver to the registered keeper)

    Don't expect them to accept your appeal, especially as you have left it open that you might not have registered.

    s you are a regular user have you asked the manager/owner of the gym to intervene?

      Last year I parked in the carpark of a Premier Inn / Beefeater just outside Leeds Bradford Airport after a return flight to dine with my family.
      On entering the Beefeater, apparently there is a terminal to register your car, but we were approached by waiting staff who simply took us to a table.
      A simple phone call followed up with an email to the parking company with a copy bank statement showing we'd eaten there was enough for them to cancel the ticket.

      My wife also parked her car in a car park where she has her hair done and the salon forgot to ask her registration to put on the system. A ticket arrived a week or so later. A simple call to the salon got his resolved as they contacted the parking company confirming the appt.

      If you are a gym member i'd assume there is some form of signing in process / swipe card etc that would prove you are a) a member b) were in the gym at the time. As Des8 says, get the Gym manager to contact the contracted parking company.
