    Today I received a notice from Euro car parks relating to a 43 minute stay at the Wetherspoons in Kings Norton Birmingham. We called in for a drink two weeks ago and while we did see signs we kind of assumed they were similar to the Wetherspoons in Northfield Birmingham which is a 3 hour limit.

    I have called the pub who say if we call in they will cancel it which we will do but am I right in thinking these are not legally enforceable. When I go tomorrow I will take photos of all the signs I can see.

    Any advice would be gratefully received

    Legally enforceable?
    If you ignore the PCN, and the follow up letters and the court papers, they will certainly obtain a county court judgment in their favour.
    If you contest the letters, they will probably still initiate a court claim, but if you defend that they might well discontinue their claim.
    If it then progresses to a hearing you might well win, although it is a bit of a lottery and nothing is certain.

    Take up Wetherspoons offer to have the PCN cancelled, and obtain confirmation in writing.

    If you can post up copies of the redacted PCN & signage we might then possibly be able to suggest a line of defence if the parking company refuse to withdraw

    Do not identify the driver if you communicate with them, or when posting on here

      Unfortunately before I read your reply I went to the pub and handed over the notice but have the name. I also entered my registration on the console- you need to be Sherlock Holmes to find it- there is one on a long bar- you know how big Wetherspoons are . My partner is going on line tonight to look for the credit card transaction. I have appealed.

      What I find disgraceful is that they say, if you appeal to POPLAR? you can not get the discounted rate. I think that might be an unfair term but that's another story.

      I am sorry my scanner is letting me scan then print but my MacBook will not save it to a file- tomorrow evening or sat I can use my partners filth PC to do it or try and reinstall the HP 'easy scan' app.

      I have to play the best game as I am on a limited income at the moment

      I have referred to 'we' in all correspondence apart from today when i said the signage in the entrance was impossible to see and safely drive if turning left into the carpark.

          Just an update- I logged on to the website today and Wetherspoons have been as good as their word and the case is closed. I hate saying anything good about a company owned by Tim Brexit/Go and work in Tesco Martin but here I have to.

            Well done
            Just take a screen shot and print & keep for 6 years a copy of that closure as parking companies are not unknown to have resurrected such cases a couple of years down the line!
