  • CCJ on deceased ex

Hi, not sure if this is the right page to post. My ex husband died in July 2023. In September someone using his former vehicle parked without a ticket. As my husbands property was empty, when I collected the mail in October I found 2 letters from the carpark management company. I rang them straight away and explained that my husband was dead and that it was therefore not him that they needed to chase up. I fave all my details as a contact and was told to put everything in an email to them which I did. One month later they emailed back to say I had not included proof of death. I immediately emailed them back with a copy of the death certificate. Another month later (December) they acknowledged my email and said the matter would be resolved. In February I again visited the property and found a letter advising that the debt was now going to court. I completed the forms to appeal and posted it stating very clearly that my husband was dead, the property was empty and I was the next if kin (address, phone number and email included). It was sent within the time limit on the forms. Today I have picked up thd mail at the property and have received a CCJ (dated 7th March) in my husbands name and a letter returning the completed court forms saying that they were received too late as the CCJ had already been issued (dated 8th March).

Is it possible to have this cancelled without paying the £275 fee? I don't have the money nor should I have to pay go clear someone elses cock up.

If paying the fee is the only way forward, is it possible to claim back the fee and claim compensation for all the added stress brought on a grieving family?
