  • Smart Parking PCN Sent Out Late

    Hi all, thaks for reading this. I received a PCN 16 Days after Date of issue on the letter. Im willing to pay £60 but definitely not £100. Can i appeal this through their online portal and what are my chances of getting the letter re-sent with the discounted rate please? Many thanks
    ps. There is no mention of 'Freedoms Act'

      You could write to them along the following lines and not pay anything.
      Do not identify the driver, (and that includes on this thread!)

      Dear Sirs,
      I have received your Parking Charge Notice xxxxx issued 30.10.23 for a parking incident involving vehicle VRM xxxx on 05.10.23

      I am the registered keeper of that vehicle, but you cannot transfer liability for the alleged charge from the driver at the time to me, the keeper.

      This is because you have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to,, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act.

      There is no legal requirement to name the driver at the time and I will not be doing so.

      I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.
      Yours etc

              hopefully, but do not dispose of the paperwork yet as they have 6 years in which o initiate a court claim
