PCN - help with appeal pls

How best to appeal a private PCNs please. Gemini, BPA member.
I was not the driver.
I can’t see any reference to POFA.
Incident was on nov 20th & the letter arrived on dec 7th.
Are they out of time to rely on pofa or have I misunderstood the law.
