  • Britannia Parking Parking Charge Notice

    I received a PCN from Britannia yesterday but was not driving the vehicle at the time of the alleged contravention- can anyone advise if I can simply refuse to provide more info other than it wasn't me, or is there any scope to refuse to pay given that the PCN arrived after more than 14 days?

    I've tried to add attachments but the forum is saying I don't have permission to do so,

    Date of contravention was 19th Aug.
    Date of notice is 06th Sep
    ANPR camera operated site- no ticket received at the time.

    There is no reference to POFA I can see on the notice.

    If dates are as you say then:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    I was not the driver at the time and as there is no legal requirement to name the driver I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    First class post with a free certificate of posting from any post office.

    There may be no mention of POFA as they know they cannot rely on it.

        Further to the above I heard back from Britannia yesterday with a Final Reminder and then also a further letter saying that I can change liability.
        The make no reference to the 14 days and it's obviously trying to get the name of the driver from me.

        Do I need to take further action to try and "close" the matter down?
