DCB Legal on behalf of One Parking Solution Ltd. have issued a claim that I, as the registered keeper, need to make a statement of defence for.
This was a company vehicle and I honestly can't remember who was was driving at the time back in 2016. It could have been any of twenty people.
It appears that they have followed the POFA by sending the notice to keeper 55 days later (they have photos of the original PCN on the windscreen too), although I do not remember receiving it.
A section from their claim statement.....
"As per Section 8 of POFA, if a PCN is affixed to the Vehicle, my Company has 28 days after
the expiry of the initial 28 days’ notice to issue a Notice to Keeper in accordance with POFA.
My Company had until 30/11/2016 to issue a Notice to Keeper. The Notice to Keeper was
issued on 29/11/2016. Therefore, my Company has complied with POFA and can pursue the
Keeper."
I'm not sure if the points I've made above are enough to provide a decent defence? I'd appreciate any advice anyone could give on what to put in my defence statement.
