  • Smart Parking Fine(s)

    Hi all, my partner and I both got tickets from Smart Parking in Bury from a week ago (parked Sunday 27/11), letter received this Saturday. We were collecting a soft from Jysk (needed to take 2 cars as had 2 children who we couldn't leave at home) so parked in a Smart Parking car park and went over the hour (we were in store longer than expected, took a while to get and load the sofa, etc). We both have £60 fine (£100 if not paid within 14 days).

    Best course of action for this? Once upon a time you could send a boilerplate letter stating that the fine was not appropriate for the loss.
    Would Jysk be able to contact Smart Parking (they are not the sole business for this car park)?
    Should I appeal to Smart Parking?
    What about having to disclose the driver?

      Let's see the PCN's you received, suitably redacted but lave dates.

      Have you contacted the store to request the charge is cancelled?

        I called them today but apparently they have nothing to do with the car park. Both the letters we received are the same;My partner left at 17:16.

          Dear Sirs,

          I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

          You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

          There is no legal requirement to name the driver at the time and I will not be doing so.

          I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

          What was the date on the letter and the date of the event?

          they will reject but your POPLA appeal should be successful when all the POFA fails are included
