  • Parking fine for parking at my own home in 2018

    Hi everyone,

    First of all I hope everyone is well.

    I received a letter from Gladstones Solicitors (attached) for parking at the property which I rent, the bay number is stated on my tenancy agreement. This letter refers to me parking there in 2018 which was around the time I actually moved in. I know they require parking permit (you have to pay something and display this on your dashboard) However, I probably was waiting for one to arrive. Anyway they can see I am a resident there since they sent letter to the same address where I parked. I had no idea about this incident and even if I did receive a parking notice in 2018 I would have called the company to tell them I live there and I am a resident. The vehicle they are referring has been sold on 8th of November 2019. What should I do in this situation ? Call them and explain everything ?

    Please could you give me some advice.

    I attached all the letter I received and kept the address visible so you can see that they match to where I live and where I parked.

      Have you got the section from your lease where it allocates you a space? If you already have a contract to park then you have no need of the contract to park offered by UKCPM. Your lease will make no requirement to display a permit nor pay a third party stranger if you don't. You display a permit purely for the benefit of the operatives with no intention of creating a contract between you. Your lease is superior to anything UKCPM have to offer.

      They probably got the incorrect address from the DVLA if you had just moved.

      Can you post images of the signs.

        Thank you for your response.

        I moved there in 2018 when they issued the penalty notice. Yes, this bay number (102) is in my tenancy agreement. I always parked in my own spot.I don't think they have incorrect details, since they mention my previous vehicle and my address. I probably got a penalty notice when I moved in because I was waiting for the permit to arrive, you have to pay £5 and I think within 3 weeks they send you a permit which you display. However, I would have called them and explained that I am a resident and entitled to park in this bay.

          The sign is forbidding, it is not offering a contract to park for non permit holders.

          can you post up the section of your lease that gives you the right to park.

          You may have to contact the landlord, explain the situation to him and ask him if the space is demised to him under his lease. The reason being is that if he is the landholder then the parking company require a contract with him in order to operate

            Offices are now closed. I will get in touch with the landlord on monday and ask him to send me the documents. Perhaps it is the building management company that I will have to get in touch with. The plot number for the car park was given to us in the first agreement(2018), that's how I know this parking spot is related to my apartment.

              You are dealing with the landlord as they are the landholders. Be polite and humble. If the landlord owns the parking space then he can hand on that right to park and the parking company are trespassing on land they do not hold a contract for. You only need the bit of his lease that shows he owns the parking space. You could of course get the details from the land registry.

              It's noting to do with the building management company.
