  • 52M PCN Grounds of Appeal

    Hi,

I got a PCN 52m - failing to comply with a prohibition on certain types of vehicle (motor vehicles) on 16 March 2020.

I did enter the road but thought there was an exemption for zero emission electric vehicles as the bye law was put in place for cleaner air etc.

Is this a valid ground of appeal?

    Any help appreciated!

That exemption applies to the* Ultra Low Emission Zone (ULEZ) but 52m applies to all motor vehicles (electric or otherwise) even within the ULEZ.

Unfortunately that is not grounds for appeal.
Suggest you pop along to Pepipoo (http://www.pepipoo.com/) as they are the experts on PCNs and there might be other grounds on which to challenge this PCN
