Debt Recovery Plus Intended Court Action

Hi,

We parked our car at a pub a few months ago, which has a car park that doesn't even charge, but you do have to type in your number plate at a machine.

We swear that we DID type in our number plate and we were using the pub.

We received a letter from Euro Car Parks a few weeks later with a Parking Charge Notice and a ANPR photo of our number plate and a charge of £85.00.

We received two letters from Euro Car Parks and now have received two letters from Debt Recovery Plus.

The last letter is threatening "Intended Court Action" and is asking for £145.00.

I have attached a copy of the latest letter:

Should i just keep ignoring them?

OR should i do something such as appeal or contact them?

So DRP can't take anyone to court, it's not their debt.

How many weeks was "a few weeks later" ?

Post up a redacted* copy of the original PCN but leave dates.

We received the first letter 1 week after the incident, but we genuinely didn't see this letter until much later. The first letter that we actually saw was the 2nd letter, 1 month after the event.

I have attached a copy of the first PCN letter (dated 27/09/19).

Your response should have been aan appeal to ECP as follows:

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. *You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

The notice gives the breach as unauthorised stay.* What do the signs say?

I can remember fully. But the sign in the car park says something along the lines of Pub Patrons only and asked all car park users to input their number plate in to a machine.

My partner was using the pub, along with 3 other people and she says that she did enter her number plate in to the machine.

I've contacted the Pub Chain on Twitter with a private message with full details, but also with a public tweet referring to the £85.00 PCN for a paying customer of one of their pubs.

I've also emailed my local authority Councillor.
