  • Parking Charge Notice Received after 14 days

    Hello, I have a lease vehicle and have received a letter today from my lease provider advising me that they have received a Parking Charge Notice (PCN) dated 04/11/19 for a parking contravention on the 05/09/19. The lease company have sent me a photocopy of the PCN for information and have confirmed they have sent my details to the parking enforcement company. I therefore suspect I am likely to receive a PCN in the next few days.

    Having done some digging, I suspect this can be appealed as the terms of The Protection of Freedoms Act 2012 Schedule 4, Paragraph 9 (5) and Schedule 4, Paragraph 13 (b) have not been met i.e. the PCN has been sent outside of the 14 day window and the lease company should have received this by no later than 19/09/19. I wanted to check if this is right before I appeal, does anyone know if this is correct and if so how I should word my appeal email? I am awaiting any PCN etc from the creditor before I contact them.

    Was there a windscreen ticket, if so then paragraph 8 applies.

    It is unreasonable to expect the 14 days to apply to hire car cases and this is covered in para 13 for the lease company and 14 for the hirer.

    You are the hirer/keeper of the vehicle. The parking company are required to include with the Notice to Hirer that they send to you a copy of portions of the lease agreement AND a copy of the original PCN. Paragraph 14. Most fail this requirement and so do not comply with POFA and yet another reason to reject. If they fail to supply the docs then send the appeal so that it arrives just before the 21 day relevant period so they cannot correct their error.
