    Before commenting, is there any chance that, in any correspondence, the driver has been ID'd?

    You've already said no, so good.
    In that case they can only try, via PoFA, to tranfer liability from the driver to the RK.
    To do so, they have to adhere to the mandatory provisions of PoFA Schedule 4.
    & it would seem they haven't.

    At this stage I would email the sols & copy in the parking co of their failings.
    If they take no notice, that can then be used by you in court/pleadings should it get that far.

      You write to BWL as they are handling matters. Point out that the NTKs were delivered outside of the relevant period of 14 days that is required by POFA 9(4) and therefore there can be no keeper liability for the actions of the driver. To continue when there is no prospect of success is perverse.
