    This is my first post on the forum. The driver received paperwork today which they are not sure if it is genuine or a scam. The alleged offence relates to a PCN received from Britannia Parking in September 2016, after the driver parked in a private car park and paid for a ticket. They received the original PCN which alleged I had over stayed by a few minutes. The letter said they said they had photographic evidence of the offence.

    The driver googled the company and very quickly found many reports of Britannia parking sending out claims to individuals who had paid a fee. The consensus seemed to be it was a scam, therefore they ignored all their communications and they ceased after a while, until the end of 2018 when they began to receive letter and also emails from BW legal, trying to claim for the alleged offence. They have so far ignored all communications, until today when they received a claim form from Northampton County Court Business Centre (information about them is here: https://www.gov.uk/courts-tribunals/...usiness-centre

    From what I can gather if the driver doesn't reply they can receive CCJ and then an alleged debt which was not enforceable becomes enforceable and they can send bailiffs round. The driver is a single parent to three young children. The driver is also a student so doesn't have any spare cash to pay. This seems so unfair. Any help would be much appreciated? The original PCN was £100 and they want £252.42 now- but the driver did buy a ticket, however they cannot prove this, because they paid cash, and the ticket was lost by the time the PCN was received.

      Edit you post so that the identity of the driver cannot be inferred, use "the driver........" etc.

      Also take down that picture and remove the password, the claim number and the registration number of your car. then repost.

      Then go to the address given on the form and acknowledge the claim using the password on the form. Do not put anything in the defence, You now have 33 days from the date of issue to get your defence to the court.

      You are handling this as the keeper of the car.

      Have you retained the original PCN you received? Would be nice to see a copy of that.

      If you have not kept it then a SAR to Britannia requesting that they supply all the documentation that is relevant to you. Do this NOW.

      As the keeper they cannot claim from you more than the original £100 on the PCN + the court cost and solicitor fee.

      Britannia are members of the BPA and their Code of Practise requires that they give a minimum of a 10 minute grace period at the end of parking.

        Edit again. The driver drove and parked the car, the keeper received the paperwork.
