    B W Legal on behalf of Britannia Parking has just sent a demand for payment for a parking charge notice that my daughter incurred. There are two letters addressed to myself and my daughter threatening court action. I am the Registered Keeper and she is the owner of the vehicle which has since been sold. They have also access my credit report on Equifax - Can they do this without my permission.

    Help do not know what to do. I am a war widow and I have a mortgage to pay and cannot risk any CCJs against me.

    Stress levels are way through the roof now. Some say ignore and some say contact them. I have received no previous paperwork from them.

    There will be a CCJ against you only IF they actually go to court and IF you lose and IF you do not pay within a month.

    Is this one letter addressed to both of you or two letters, one to each of you?

    So you, as the keeper, have not received any previous paperwork from them and they are threatening court. Is this letter entitled Letter Before Claim (or similar) or something else? Can you post the letter up with identifying details removed.

    If you have not received any previous paperwork then they cannot claim against you, as the keeper. To be able to do this they have to send the keeper a Notice to Keeper within a specific time frame. You have not received it therefore they can only claim against the driver, who they do not know, and there is no requirement to tell them. Don't even mention the identity of the driver on here.
