  • PCN first notice from debt recovery agency

    Hi. I received a notice from a debt recovery agency working on behalf of Premier Parking on 3rd November 2018 (dated 24/10/18). they are requiring me to pay £100 pcn plus admin charge of £70. I have no wish to pay this as it seems a little unfair to say the least that this is the first notice I have had of any charges owed.

    Parking charge probably is owed BTW as was in the area at the time and research shows they have a good success rate at prosecution on this car park, The George at Braunton.

    I have now received second and final notice from ZZPS that it will be passed to a solicitor.

    Any advice gratefully received.

    ZZPS cannot pass this on to a solicitor as they are mere debt collectors and don't actually own the debt.

    Edit your post so that the identity of the driver cannot be inferred. Use "the driver ......" etc. Delete the second sentence

    Then send Premiar Parking the following.

    Dear Sirs,

    I have just received A demand from debt collectors you appear to have engaged about a Notice to Keeper xxxxx for vehicle VRM xxxx

    This is the first correspondance that I have received about this matter and as such you have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver a Notice to Keeper within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any other Debt Collection companies you care to instruct.
