    ostell like you said might happen I have just recived in my email today a rejection notice to my appeal, now I will appeal to POPLA could you please refresh my memory in what would be the best thing to say to them? considering I have no advised to back up what I am saying?

        Can you confirm if the driver had a windscreen ticket.or not please?

        If not then there will be 2 major appeal points to POPLA.

          ostell no window ticket, just a ticket through the door 27 days after the date car parked there

            That's good, there are several failures at POFA that should see your appeal to POPLA be successfull

            You write as keeper. Find other POPLA appeals and modify to suit but

            1) Failure to comply with POFA to be able to hold the keeper liable
            9 (2) (a) the period of parking is not specified. "Prior to" is insufficient and is an indeterminate time.
            9 (2) (f) Failed to warn the keeper of their potential liability
            9 (4) Failing to deliver the Notice to Keeper within the relevant period of 14 days.
            Because the operator has not complied with the strict requirements of POFA liability cannot be transferred to the keeper.

            Notwithstanding the absolute failure to comply with POFA there is also:
            2) Unclear signage
            The signage was unclear and failed to properly specify the land to which the notice applied.

            And anything else you care to come up with.

              I'm in a similar situation with initial appeal rejected by MET. Can I ask if you appealed to POPLA and if so, were you successful?

                I believe that POPLA will respond within 28 days but I can't remember exactly.

                Can I suggest that if you want additional help that you start your own thread please. Post up PCN and your appeal. Two case on one thread gets confusing.

                  ostell Thank you for that. I am in process of appealing now. I seem to be at a loss om the first step of my appeal to POPLA there I need to tick why I am appealing and I'm not sure whether to choose 'other' or 'I was not the driver or registered keeper of the vehicle at the time of alleged improper parking' i am sure on other forums I have seen they were told to choose the second option but wanted to check with you in my case the best option

                    Hi There,

                    I have a similar issue with this parking area.


                    A while back I parked (13th July 2018) at Stansted's Starbucks / MacDonalds car park prior to returning my hire car.

                    The car park was real busy and with trying to avoid a collision with someone and find a parking space I did not notice all the parking signage.

                    I parked up (apparently in Starbucks parking lot) went to Mac Donalds (approx 30min) and left.

                    A few weeks later (17th August parking notice was apparently issued but the notice to hirer is dated 11th September 2018) I got a parking charge notice for £100 (notice was forwarded to me via the car hire company and the agent that booked my hire car) saying I left the car park.

                    I appealed to MET parking showing the receipt from Mac Donalds as proof of my using a premises on the site.

                    Appeal has been rejected and asking for £60 as they say I was in breach of Starbucks parking rules and regs.

                    Is this worth appealing?

                      Could you start your own thread as it gets very confusing trying to deal with two incidents on one thread. Usually NTH are very appealable.but you may have blown it. Your own thread please with full story and don't identufy the driver.

                            That item about starting your own thread was for the person that butted in to your thread and could have, and possibly has, caused confusion.

                            You tick "Other" for that POPLA appeal. There should be lots of POPLA appeals to copy from. Post up here for critique before you submit.

                              ostell appealed to POPLA and just found out today the charge has been dropped so no parking fine to pay! Thank you for your help!
