PCN £100 too much ?

The driver unknowingly parked in a retail park that had a parking condition allowing them to park for free providing they used the shops/restaurants and didn't leave the site.

They left the site and has got a ticket for £100, reduced to £60 if paid within 14 days

It was an innocent mistake (albeit careless).

The car park was approx. 50% full so the charge seems more like a penalty - the owners of the Park could not have lost any trade etc as a result

Accordingly the amount seems extortionate . Have we any chance with an appeal ? Any advice please

Hi & welcome to LB.

Do you live in England/Wales?
Is the car on HP/lease/hire/company vehicle etc.?
Was there a windscreen PCN issued?
When did the parking event occur?

It is best not to ID the driver.....just refer to 'the driver' or 'the registered keeper' where appropriate.

If you still have the windscreen PCN, could you post up a pic on here.

Do nothing atm re appealing....wait for the postal Notice to Keeper (should arrive 29-56 days after the parking incident.)

Also, could you edit your original post. It is not wise to ID the driver, even on an internet forum.

If I wait past 14 days the charge will obviously go up to £100. Have I a high chance of success at appeal or should I just take the £60 hit ?

UKPC are fairly litigious.....218 court hearings so far this year.

In all the cases I've seen, the discounted amount is also offered to the registered keeper. (That makes some kind of sense, as the RK could be a different person to whoever was driving, & might not be aware of a windscreen PCN [Notice to Driver]).

If it were me I'd hold fire until/unless a Notice to (registered) Keeper (NtK) turns up. (29-56 days after the parking event).

Did you take any pics of the site signage?
If not, can you?

no pics were taken and is an hour round trip to return . What would we be looking to demonstrate ? - that the signage is inadequate ?

If UKPC are litigious sounds as if the NtK will arrive.

As I start to understand more about how all this works my current thinking is that the argument it was extortionate/not properly signed is going to end up with a court battle since they are litigious, which we wouldn't want. They are unlikely not to send the NtK since seem well organised and there is the risk that the £60 option won't be available (although your comments noted). So I am probably going to end up paying £60 so may as well do it now, then forget about it and enjoy Christmas !

I always wonder how they can prove that someone has left the site?
It seems like it would boil down to one person's word against another. Or maybe 2, or 3, if there were passengers.

If it were me I'd wait for the NtK & decide from there
