Re: CEL Ltd parking fine whilst working at Oldham hospital.
This is the email/letter i will send to CEL. Any advice is greatly appreciated on this.
Good morning
I am emailing regarding PCN ***********
Yesterday the registered keeper received a letter saying the outstanding debt is now £110, they have yet to receive a letter telling them they had a debt and apart from a ticket which they believed was dealt with this is all they have had.
In mitigation to the charge and the reasons they feel they would like the ticket cancelled are as follows:
1. The driver is a current serving prison officer employed by HMP ******* (they can not provide id number or prisoners details as per OSA and to do so or ask to do so is a crime) and was working at Royal Oldham Hospital on ********** on an approved bed guard. The driver was instructed by hospital staff to provide details of the vehicle so to stop any charges as they are exempt from parking charges also they were working on ward T2 which carries an exemption from charges. The driver provided details to hospital staff and was then handcuffed to the prisoner and unable to move for the shift. Hospital staff informed the driver that if he does receive a ticket to contact the hospital again it will be dealt with, he did this and believed that was the end of it.
2. The drivers colleague who they were working with received a ticket and contacted you directly and had the ticket erased so the driver is asking the same treatment.
3. The driver arrived at 05:25 and the signage was unclear due to being dark.
4. The driver believes that correspondence should have arrived within 28 days, allowing them time to appeal, as this has not happened they believe the ticket should be dismissed.
5. The driver understands the need for people to be ticketed but on this occasion believes the fact that they were there to protect members of staff and public from said prisoner that they meet valid mitigation to have the ticket dismissed.
