    Hello, I bought a banger for £400 2 years ago and didn't do a HPI check, I went to scrap the car after the MOT expired and was informed it had finance on it, I did a HPI check to find the finance company details (mobile money) and rang them, a previous owner to the loan out, I asked them if they could remove their interest in the car and they said that the wouldn't as long as money was owing, I then asked them to collect the car and again they wouldn't due to the cars value, is there any way I can force them to remove their interest in the car or to remove it from my garden?.

    Bit of an odd one is this.

    Are you in a position to physicaly strip this car into it's bare componants and sell them on. ?
    Ie leaving you with a bare shell.

    If you can do this, Maybe it would be worth writing to the financial company and explain the situation to them again, however on this occasion explain what you are about to do, Giving them 14 days to either recover this vehicle or to abandon any claim in the vehicle send this notice by signed for delivery.

    It is quite odd that that if this vehicle is owned under a logbook loan that it has not been reposessed by the creditor of such, Having said that to my knowledge log book loans/ bills of sale are no longer enforceable, this may explain the reluctance of the creditor to make a claim on this asset irrespective of the value. I would therfore await further legal input from those in the know from here

      Suggested letter:
      I HEREBY GIVE YOU NOTICE pursuant to the Tort(Interference with Goods) Act 1977 that the goods, Vehicle model & make Registration Number****, are being held at ********
      These goods are available for collection upon reasonable notice and payment of my storage fees of £** per diem for a period of three weeks from the date of this notice.
      If you fail to collect the goods within three weeks of the date of this notice, or fail to remove the notification of your interest in the goods I reserve the right to dispose of the goods and use any money raised to set off the debts due to storage fees, the balance of which will remain due.
      Yours

      If you then go on to dismantle the vehicle and scrap it yourself (got an angle grinder?) remember to keep it SORNed for ever after!

          Thanks all, don't really fancy chopping it myself but I can get someone to do it and maybe sell the engine as that works ok, it's frustrating though that the scrappers wont deal with it due to the loan on it as it has no value, I don't think I will write to them though as they have already told me they aren't interested in the car and don't want to recover it, I might put it on autotrader for a pound and save myself the bother.

            They may have said they ae not interested in it, but was that in writing?
            As you are an involuntary bailee, you should not dispose of it without first telling them of your intention (in writing recorded) as you are responsible for looking after it.
            To just sell it leaves you open to court proceedings.
