  • Marsh finance voluntary termination issue!

    Hi can anyone help.. cancelled by dd Friday as over 50%of car paid as agreed in November unable to contact any son plan ring to give verbal termination as agreed
    Problem they range me thus morning before 10am ..women was abrupt and intimidating..saying I'd cancelled my dd Friday payment was due Sunday..explained as bank holiday x2 days planned to give verbal today she insisted they wouldn't agreed to VT as now in arrears as I didn't ring them on Friday!! Was really stressed as need to sort this??
    1 . Do I make this payment as they only reviewed physically today bank recalled it today ..I checked
    2 am I in arrears despite being over 50%paid and planned VT as discussed with them in November
    Help please asap ☺ many thanks

    1. Yes you owe the arrears, you didn't give the notice before it was due and cancelling your direct debit before you cancel because you were going to give notice is not an excuse - you give notice first then cancel your DD.

    2. They can't refuse to accept the VT it is a statutory right and you can cancel at anytime even if you are in arrears but you still owe the arrears when you cancel.

    I would suggest you put it in writing rather than overthe phone, it is always best to have a paper trail in the event of a dispute. If I were you I would put in a formal complaint in writing, explain you called on Friday to give notice to terminate under section 99 of the Consumer Credit Act. The fact that you are in arrears is no defence and they cannot refuse to accept the termination. Therefore termination of the Agreement was today and at the very latest the date of the letter/email.

      Arrwww thankyou wasn't quite sure where I stood ..that's really helpful if I ll ring them today and restart the process again ....
