I want first to introduce myself- My name is Latkan, and I came across this fourm through google as I have been searching the internet for a solution for an automotive issue that I am currently facing.
I bought a BMW 1 series from the AMC Motor Solutions which is a used car dealership in Coulsdon, Surrey on the 16/04/2016 but paid the full price of the car on the 19/04/2016 this is due them carrying out the MOT after the initial deposit was paid on the 16th of April.
The car mileage at the time of purchase was 53,010, and since then I have driven less than 500 miles as I only use the car on the weekends for social meetings.
Recently the car engine light came on, and I took it my local BMW dealership in Thames Ditton to diagnosis the fault. They have now come back to me with a full diagnostic report and said that my air mass sensor and wire harnessing would need to be replaced and quoted the work to be approximately £2,000.
As this is nearly 1/3 of the price, I paid for the car which was £4,750 I contacted the AMC dealership I bought the car from and told them about findings from BMW Thames Ditton. However, the AMC dealership manager has come back and said that the 3 months’ warranty has expired and they can no longer do anything.
I then rang them up today and told that as I bought the car referenced above car from them on the 16/04/2016 and therefore technically under the consumer right act 2015, I am still within my six months right as a customer to be entitled to a repair, replacement or refund.
I am not completely sure if the consumer right act 2015 covers the automotive sector and if it does then I am legally in the right to get a refund or ask the dealership to pay for repairs?
As the 6-month window is coming to a close on the 16th of October 2016, I am worried that the company might delay resolving this problem till I am outside the 6 months window and then refuse to help me.
What can I do from a legal point to get this sorted? Lastly, if they do agree to help does the clock stop or can they say they will resolve my issue but instead count the clock down?
