  • Voluntary termination

    Hi,
We have done a voluntary termination on our car and are due to return this in Wednesday (29th).
Firstly, the finance company are stating that the condition report will be done but we will not have any say in what is put on it and will not be given an opportunity to either sign or not sign this. Is this correct?
Also theyre is a very small dent on one of the doors (about the size of a £2 coin) however, this was there when we purchased the car. The finance company are saying that we would have to prove it was already there. Is this the case? Ive read lots about finance companies trying to claw money back by charging ridiculous amounts for things like this.
    Thanks :-)

    Re: Voluntary termination

You are not legally obliged to sign anything, so it does not matter whether they say you can't sign it. If you sign it you are effectively agreeing to pay any of the damages listed, and I would advise against that.

The burden of proof is on them, if they did not conduct an initial inspection, then you can simply say that you negotiated a price based on the dent on the car and it would be up to the finance company to prove that the dent was not there before you took possession of it - which of course they cannot prove This is why you are always best to take pictures before you take possession so you can prove what state it was in at the time, and send them onto the finance company so they can't deny they ever received them.

Who is the finance company and is it Manheim who are carrying out the inspection?

      Re: Voluntary termination

      Hi R0b,
      Thanks for your reply.
The finance company is Advantage. Im not sure who is doing the inspection all i know is we are to take it to Hyde.
I guess it is a case of simply returning the car and then waiting to see if they do try and charge us for anything.
We had it MOT'd last week which it flew through without any advisories so the dent was the only thing i thought they would be able to try and claw some money back from.

Make sure to take plenty of photos inside and out before you hand it over in case of a dispute, they will probably want to recover money for the dent I suspect.

In the mean time take a look at this link so you have a heads up of what to expect and some common questions and answers
