  • HELP! After Voluntary Termination Moneyway

    Hi,

    Looking for some help please from someone in the know.

    I recently VT'd my car with Moneyway as it was worth substantially less than the market rate at the half way point. I never missed a payment and all that good stuff. I should add that I am actively trying to improve my credit score so I would not do anything that would harm it and I understood from this forum that VTing would not although there would be a comment placed against the closed account/agreement.

    I checked Equifax a month or so after the VT was accepted to find that Moneyway had put a late payment against my account. I politely asked by email for them to remove what must have been an error as the car was VT'd some 3 weeks before the march payment was due. I never got a response and generally live by the 'no news is good news rule'

    I have just checked Equifax again to find 2 late payments for March and April now.

    So the question is, how can they do this, and what can I do to get this removed. I have sent them an email advising that if they do not resolve this I will report the conduct to the FCA but I'm not sure that will do anything.

    At this moment I am absolutely furious as I have the outstanding balance of the finance showing on my credit file and I don't have the bloody car. This conduct has to be unlawful.

    Any advice that will make them rectify this will be gratefully accepted.

    I would suggest writing to them, and put them on notice that they are inaccurately reporting information. Your notice to terminate was given 3 weeks prior to the following payment and provided such notice is given, no further payments are required. You should also make them aware that inaccurate information is contrary to Principle 4 of the Data Protection Act and that they should immediately remove the inaccurate information and provide confirmation within the next 7 days otherwise you will seek an application to the court for the removal of the information along with costs and compensation.

    Send it by email and also add to the end that the contents of the email has been sent by letter as well.

    Santander did this to me and as soon as I threatened them they removed it within a few days of sending the letter - If they leave it then you can complain to the ICO which takes time or take it to court.

    Worth reporting them to the ICO anyway.
