  • PCN - Falsely issued

    Hi,

I will try to make this as simple as possible. I'm pretty sure I'm in a position of strength here just need clarification.

Scenario: my girlfriend parked in a car park with ticket machines.

She paid for two hours parking, and had to enter the car reg on arrival into the machine which she did. The ticket issued clearly showed a departure time but just "V2" of her registration. She leaves the ticket in the window and goes off to do what she needs to do. Returns after approx 1hr 30mins and goes on her way.

Weeks later, she gets issued a PCN showing she overstayed by approx 30 mins despite leaving early.

She has appealed this, and emailed the recovery agent a copy of the parking ticket. They are now alleging that because she 'overstayed' (clearly untrue) she is still liable. Current cost is £173. I have advised her as that she has a ticket clearly stating a 2 hour stay was paid for, their claim is false. They use ANPR cameras to police the car park, so to my mind this is demanding money with menaces. They have declined the appeal, and I have advised her to tell them to send on the claim to the small claims court. She has done this, yet no reply as yet recieved.

My question therefore is, do we need to pay these Charlatans now, or can we go to court and perhaps get some money from them for all the aggravation and time. These people are a disgrace.

    Cheers.
