I will try and keep this short!
A couple of months ago PE decided to send through correspondence relating to 5 different 'fines' some nearly a year old for staying in the free car park at Morrisons Reigate, one of which had got as far as them starting a county court claim. I appealed to PE who said I was outside their 28 day period so it was too late to appeal. I then contacted Morrisons who contacted PE and 4 out of the 5 claims were dropped. PE refused to drop the one they had started court action on although they have sent a letter saying that they are aware I was a genuine customer that day.
They are now demanding that I pay their costs associated with the court claim, which they say is £60.
I have replied saying that I will pay the £25 court cost since this is the only cost they have listed on the court claim other than the solicitors fees which are £50 and I assume would only be incurred were the matter to go to court, otherwise they would be demanding £85.
They have now replied saying they will not accept £25 but will go to court and pursue the claim in its entirety.
A couple of questions.
All the correspondance they have sent is 'without prejudice', does this mean that I cannot use the letters cancelling the other 4 charges in evidence relating to the 5th charge?
I have a letter from Morrisions (which I assume I can use) but it just says the charges have been cancelled giving no reason, will this help?
I am tempted to go back to them and query what they are actually saying their expenses are, will this help?
What should I do???!!!???
