    Hello members

    I would like some help if possible. In may 2024 a third party driver ran into my car and Admiral wrote it off because of the age of the vehicle & repai cost.
    I was fully comprehensive. The third party insurers (One Call) admitted liability (according to a phone call I received from Admiral) Admiral paid out minus the mandatory & voluntary excess. Admiral said the third party driver hadn't contacted their insurers at that time but Admiral still paid me out and the transaction was done over the phone.
    This week I received an email from Admiral stating that they have not received the payment (from One Call) and have now instructed their solicitors to get the money from me including excess which, as far as I'm aware, has been deducted from the pay out I received.
    Surely I don't have to pay for a RTC that I didn't cause. Isn't that between Admiral & the third party insurers? I can't see how Admiral can demand the money from me and, especially after 6 months. Why have they waited until now?
    Any help will be gratefully appreciated.

    Admiral's position makes no sense. You had Comprehensive cover so they have to pay you irresepective of whether they are later able to claim any of it back from another driver. Payment to you doesn't depend on you being not at fault.

    Ask Admiral for an explanation of why their payment to you depended on them being able to recover from the third party. Let us know what they say. If they persist in asking for the money back lodge a formal complaint.

    Whether they can recover from the other driver might affect your future no claims bonus but that is a different matter.

      ...... and you can claim against the third party or their insurers for your non insured losses e.g excesses, extra fares etc.
