    Hi,
    I was issued a parking charge notice of £100 for overstay at the BP garage near to stansted airport, however it states ‘despite our earlier correspondence this charge remains unpaid’.
    I did not receive an earlier correspondence otherwise I would have addressed it then. Also the date of incident was 18th August 24 and only received notification of parking charge on 25th September 24.
    my question is should I still pay this fine or try to contest that I did not receive the first letter.

    Easier to advise if we can see a copy of their NTK, but if it was the filling station located at CM24 1PY that notice will not be compliant with the regulations.
    Please post up a copy of the complete notice (ex identifying details) so we can check

    Do not identify the driver when communicating with them, or on here

      I have tried to upload the letter blanking out name & address but this site doesn’t seem to accept it? Do I need to pay for this site is that why?

          So you could write to them along the following lines:

          Dear Sirs

          PCN number;xxxxxxxx

          I am in receipt of your "FINAL REMINDER" letter of 25th Sept concerning an incident at the BP filling station located at CM24 1PY

          I have not yet received the parking charge Notice to Keeper (NTK) to which you refer and would appreciate a copy at your convenience,

          In the meantime I note the location is within Stanstead Airfield boundary and hence is not relevant land as defined in Schedule 4 of the Protection of Freedoms Act 2012.
          Accordingly liability for any unpaid parking charges cannot be transferred from the driver to me, the registered keeper.

          Other than sending me a copy of the original NTK I do not expect to hear from you again except to confirm you are deleting my data from your records

          Yours etc.

          They probably won't accept it as a valid reason, but it should be a win at POPLA

                  Good morning, so following advice I sent an email with said information about the parking fine above and they have sent another letter (attached). Just wondering if I now need to contact POPLA about this? What would you suggest please.

                    So either ignore and await their further chasing letters or reply that the time limit for appealing to POPLA is 28 days from the date of their rejection of your appeal and any other time restraints are of no import.
                    Accordingly as they have not responded in a meaningful manner to your letter you are now requesting a POPLA verification code.

                    They won't take any notice of you, but will carry on chasing for the money, but at least you will have tried!

                      Ok, so just to clarify, do I ask for a verification code for POPLA even though they say they are no longer ‘available’. Or just ignore. You say ‘ at least you have tried’.
                      Im not sure if I’ll have to end up paying this fine in the long run *♀️

                        It won't make any difference what you do, unless you pay them.
                        They are unlikely to accede to your request for a POPLA code as they would probably lose.
                        They would rather continue with their letters and hope you pay up.

                        If you refuse to pay they will eventually initiate a court claim.
                        As long as you do not identify the driver, you have a very good defence as in post 5.

                        The only caveat is that small claims hearings can be a bit of a lottery and nothing is 100% certain.
                        However these companies do initiate claims but sometimes, in the face of a strong defence, discontinue or just don't turn up for the hearing.

                          Ok. Thankyou for this information. So as it will initiate a court hearing will this affect my credit score or anything else or is it only if I lose that this comes into play?

                            The only way your credit score would be impacted is if it goes to court and you lose and then you fail to pay the judgment award within 30 days.

                            If you lose the amount would be limited.
                            The solicitors fees for the other side are capped at £50 plus minimal court costs

                              Ok. Thankyou for this information. Just wondering what you would do now? Feel like I should hold off making payment going by your responses, do you know if others have been successful by not paying. Also would I have to attend court should this happen?
