  • Speeding fine received after 14 day notice period

    I received a speeding fine notice of intended prosecution, however, it is dated over a month ago. I was driving my wife's car at the time, so she received the original notice. Does this count as being outside of the 14 day notice period for such a fine?

      Assuming your wife responded to the original request by naming you, have a think about it, The first notice goes to the Registered Keeper and they have 28 days to reply. How is the second or subsequent notice to arrive in 14 days?

      Only the first Notice of Intended Prosecution (NIP) is subject to the 14 day rule and in fact it is the only notice required by law at all. Subsequent NIPs are provided as a courtesy (and also because they are usually printed on the same piece of paper as the "Request for Driver's details - which is not to subject to any time limit).

      As minor point, you have not been sent a "speeding fine". What you almost certainly have is a "request for Driver's Details" (see above). Once you have responded to that you may get the offer of a course, a fixed penalty or you may be prosecuted.
