I recently bought a car privately (although the seller is in the car trade). As it was a long way away I bought it unseen, relying on the photos and seller's description. The description was -
'Its a 1974 Alfa 1600 GT Junior,i have owned this since 1996,and am only the second owner,totally restored,but still very original,with all books and tools,with only 31,000 genuine miles from new,it really is a smashing little car ! '
When I received the car I was wary of the mileage claim because of things like wear on the driver's seat. When I queried this with the seller he replied -
'Thank you for your email, and its contents, however,this is a car that is nearly 50 years old, and I can assure you ( to the best of my knowledge ),31,000 miles is the correct mileage.'
One of the main reasons I bought the car was because of the low mileage.
I have had various problems with the car and in fact have been unable to drive it due to the brakes seizing on.
Do I have a case here to reject the car and ask for a refund (or at least a partial refund) due to the fact that he changed his mind about the mileage and I think misrepresented it or wouldn't I get anywhere because it's a private sale and I didn't go and see the car first?
