  • Private car sale - buyer looking partial refund

    Hi, we recently sold a car and priced it to sell quickly, which it did. The guy who bought it was a motor dealer. He checked it over and heard it running but didn't drive it, even though we offered. He paid cash and left the car there to be collected a few days later by what I assume were people he works with. 2 days later he sent a text (at 10pm on a friday night) to say the car needed a new head gasket and wanted to either return the car or we'd pay something towards the head gasket. Our local mechanic checked the car over before we sold it and all was well.

    How do we stand in regard to this? I've told him we had no problems with the car and he said he was going to take us to the small claims court.

    Caveat Emptor - buyer beware. You are a private seller, he is in business and assumed to have the knowledge. What is he going to take you to the small claims court for? I suspect he merely wants a reduction in the price of the car.

    So write and tell him that you had the car checked before sale and nothing was amiss. Please don't keep sending threatening letters.

    Will you local mechanic provide a statement to the effect that no problems were found. If he will then get it now and file it just in case.

      I had a similar situation - sold an old Land Rover to a specialist - pointed out all the problems etc and he said it was fine. Got him to sign for it "as seen" on pickup. Next day - demand for partial refund and threat of court. I explained I spend a lot of my time in court and have no fear of the place and told him (politely) to get lost. Didn't hear any more. I suspect he did it with all the people he bought from - if they cough up he gets a bigger profit, if they don't he has lost nothing. This trader may operate in the same way.
