Hi, Everyone, I have received a letter from County Court Business Centre in Northampton regarding a PCN ticket and the claimant is One Parking Solution LTD.

I have got a Parking Fine nearly a year ago for my own parking space where I live in the private car park under neath the building however, The parking permit sticker on the windscreen fallen off on the day I got this ticket. I appealed the PCN ticket and explained everything but they did not accept my explanation. In addition, They asked for money but I ignored them because why should I pay for my own parking spot where I can legally park.

Moreover, I do have a proof in my flat’s agreement that states the parking spot is mine to use.

is there anyone in the same situation as mine?
any help would be much appreciated.

Familiar story. Presumably you are the leaseholder and the land is demised to you in the lease. Your lease takes precedence. You have no need of another contract providing something you already have. You have not signed anything to allow a variation of your lease. Your lease does not require you to display a permit nor pay a third party stranger if you do not. You display a permit for the convenience of the operators without any intention of creating a legal relationship.

You are the landholder and to operate on your land they need your permission.

Do you want to post up the section of your lease that deals with parking and your parking space.

As Ostell says if you have an easement in the lease entitling you to use the space then lease trumps one parking solutions right to enforce.

I had exactly the same issue for a commercial client, we won on exactly that argument.
