    Hi

    I need to know what I can do to get the car back. The log book is currently in his name but the agreement is in mine. He didn’t make payment last month I had to pay (which he is unaware of, he thinks the car hasn’t been paid). I have told him the car needs to be sold and finance company paid. I no longer want to have anything to do with the car and him as he has caused a lot of stress and is dealing with this in a very irrational manner.

    I need to know what I can do to get the car keys back so that I can arrange to sell it and pay off the finance company. I cannot afford to keep making payments as I am not working. The log book states that it does not make him the owner of the vehicle. From DVLA he has recently changed the address of where the car is which is not his home address. I changed the address to his on the V5 because a couple of car fines kept coming to my address. I really need to know how I can go forward on this in the best and quickest route. I cannot afford to have name blacklisted which will happen if he does not give back the car. Can I apply for a court order to get the car back in my possession and if so how do i go about this.

        Hi I'm not sure if you have been able to resolve this matter?

        First you need to have a look at what type of finance agreement you have as in most cases what has been done is a breach of the contract and if not resolved quickly the finance company could terminate the agreement as you have lost control of their asset. The finance company may have become aware this fact as the log book isn't in your name and a request for a new one has been made with a change of address.

        For ease I would be looking to see if there is any equity in the vehicle. If not and you have paid more than half the total amount payable and the agreement is a type of hire purchase regulated by CCA. I would be writing to the finance company and asking to take advantage of your right to VT your car under section 99 of the CCA. giving your partners address for collection.

        Hope this helps and just remember the log book isn't proof of ownership.
