We have received 1 letter from Parking Collection Services and 2 letters from Debt Recovery Plus in regards to a parking charge notice for their client Parking Ticketing Ltd. The letter is addressed to my wife, who is the registered owner of the vehicle(but wasnt the driver on the day)
Date of charge 3/10/2020
Events - We went to a restaurant the parking to which was full. My friends parked at some bays next door which had a visitors parking section (and have done it multiple times before). We did the same. Upon returning we found a PCN stuck to the windshield. We ignored the PCN and a little while later we received these letters.
Letter 1 - 25/11/2020 Letter from Parking Collection Services issuing a notice for 120 GBP
Letter 2 - 21/012021 Letter from Debt Recovery Plus asking for 149 GBP
Letter 3 - 12/02/2021 Letter from Debt Recovery Plus again asking for 149 GBP or threatening court action. Also saying failure respond = making an active choice not to pay.
Our viewpoint - We weren't aware the charge is over 100 GBP to park there. Our friends have parked there always and never received a notice. I believe we parked in the row next to the visitors parking row by mistake and hence got the PCN, whilst our friends parked in the correct row and hence didnt. The were only 2-3 cars in a lot which can fit over 30, so we havent really infringed on their ability to park more cars. Given we were unaware of the amount, it feels excessive to pay the 150 GBP, specially if they don't have the ability to enforce it. My wife wasnt driving at the time, and we havent contacted them or given them any details.
Could you please advise on how to proceed with this. Would continuing to ignore these letters be a reasonable course of action. Do they have the right to take us to court ? If they were to take us to court, what is our worst case scenario? Does this really impact our credit rating?
