    Hi all ,
    I've perused the threads but can't find one which addresses my question . My PCP Nissan was collected recently at end of contract. It was 5000 miles under the contract mileage (yes under, not over). They've sent me a bill for some damage which I agree it's accurate, but since it's so far under the mileage I'm wondering whether that should give me leverage to negotiate the bill down? The guy who collected the car told me on the quiet that he has known customers to do this, especially now that PCP companies are concerned about various legal challenges about the fact that they charge you if you're over mileage but you get nothing back if you're under.* * Is there precedent for this or should I just pay up. To be fair, although I think there should be some form of credit for being under mileag , if I was them I can't imagine why I would reduce the bill at this point?*

    Shy kids get nothing. So if you don't ask you don't get, but of course they will reject your proposition.

    All you need to say is that it is an unfair contract term to allow the finance company to charge for exceeding the mileage limit but there is no allowance for the fact that the car has been returned under the mileage, given that they argue the mileage affects the value.

    The Guaranteed Future Value (GFV) i.e. the balloon payment would have been calculated based on the car being in reasonable condition and X miles at the end of the hire period. Since the car was returned below this mileage, it should therefore attract a higher value.

    Work out the pence per mile charged for excess mileage and then multiply that by 5,000 and use that figure to offset the vehicle damage, with any remaining credit to be returned to you.

        So, I have tried twice but they won't budge. Is anyone aware of anyone successfully pursuing a situation like this through the FCA? Would that be an option?

          I am about to initiate my VT with BMW and the car is around 5k under the mileage so will report back how I get on!
