  • Can anyone help? County Court Business Centre

    Good evening,

    Ivd received a letter from county court business centre in regards to s parking ticket from Feb 2015!

    the carpark in question is a private pay and display car park to which my vehicle was parked.

    I haven't heard anything for years then I received a letter a few weeks ago from a new company which I disgarded. I then received this letter today.
    I have no idea what to do I haven't had any contact with any company from the beginning admitted any liability.

    It seems I'm not the only one to receive this letter as I have seen others posting similar on social media all from 2015 and from this county court.

    I'm struggling to upload a picture due to the size?
    the POC are

    The claimants claim is for the sum of £160 being monies due from the defendants to the claimant in respect of a charge notice for a contravention on 13.2.15 at hartlepool marina
    The CN relates to a Vauxhall vectra under registration ******. The terms of the CN allowed the defendant 28days from the issue date to pay CN but the defendant failed to do so. Dispite demand having being made the defendant has failed to settle their outstanding liability.
    the claimant seeks the recovery of the CN and interest under section 69 of the county courts act 1984 at the rate of 8% at the same rate up to the date of judgement or earlier payment.

    . Any help would be greatly appreciated!

          Oh I tried but seem to have lost them - no matter the POC is typed out and the date of issue is 28th May .... don't need anything else really xxx

              This looks as though it could be subject to the Teesport and Hartlepool Harbour Byelaws 1977 You may have to do some searching around to see if the byelaws haven't been repealed.

              If the land is subject to Byelaws then their can be no keeper liability. I presume they don't know the driver at the time, nor can you remember after such a long time.

                      So a SAR to the PPC asking for all information they have about you and a letter to the solicitors handling the claim demanding copies of all documents they intend to use in court in order to narrow the issues between you.

                          Evening I've now acknowledged the claim following your guide. How long does that now allow to continue?

                          I have the address off the claimant but I cant see anything on the solicitor to forward on the SAR and ask for info.

                          Should I contact the court or the claimant. Is there also anything else I can do as i seen above about an old bylaw

                              I've just been reading into the bye law and it's hard to see where this covers. I know PD ports do own part of the deep birth dock around the corner but this site is the mandale group I do believe.
                              it's actually up for sale at the moment th ed car park in question and has been subject to alot of bad press due to the charges now being 24hours. I'll link in the advert if it helps ; https://www.rightmove.co.uk/property...-77191439.html
