  • Voluntary Termination and excess Mileage

    Hi,

    Hoping someone can inform me of the best course of action.
    I have voluntary terminated my Citroen with PSA finance and I have received a letter from them asking me to sign an end of agreement early customer response form which states I will be liable for excess mileage, damages, a collection fee and the remaining amount of my gap insurance that I have not paid.
    I don’t mind about the damages or insurance because the car is in good condition and the insurance was taken separately to the car finance. But I am worried about the excess mileage as I currently sit 14,000 above the agreed amount which I works out at a £2000 bill.
    The hirer purchase agreement states I can terminate and as long as I have paid above half the agreement which I have then I will have to pay no more. However when I have stated this to PSA they have come back with some different terms and conditions that says I would liable for excess mileage.
    I don’t know what to do next, can someone please help me.

            Hi Rob,

            Thanks for this. However PSA finance are trying to make me sign a document which says I will be liable to excess mileage and damages and they will not collect the car until I sign this document. How do I get passed this point?

                You either sign the document and return it (and I would write clearly on the document that you are signing this under duress) or you return their documents unsigned and if PSA are absolutely adamant that they won't collect the car without a signature, then you could threaten to terminate the tax and insurance if its still on there, and use the template headed notice of intention to sell goods. You can find that in the templates section.

                Otherwise its a case of back and forth.

                A word of warning though, if you sign the documents they will use that against you and you will likely have an uphill struggle.
