  • Parking eye appeal

    Could anyone possibly help me with an appea for a parking eye penalty notice. I parked in Asda Kings Heath which is free for customers for up to an hour and a half. The baby needed changing at the end of my visit and it delayed me leaving by 17 minutes. I have tried to appeal to parking eye (using the template off this site stating I was a genuine customer). They requested evidence of purchase which I then supplied. They then rejected the appeal on the grounds that there is a maximum stay time. Annoying, if they knew they would do that, why ask for the evidence?
    I now have a Popla code. What should I do next please? Any help much appreciated.

    Hi Elbie

    In any of your communications (including the 'soft' appeal to P/E) have you ID'd the driver at the time of the parking event?

          Ok, that's a good start.

          Can you post up a picture of the original postal Notice to Keeper? (Front & rear, obscure personal details but leave all times & dates visible.)
          P/E are normally pretty compliant with their paperwork, but it's still worth running 'forensics' over it.

          Btw, was this via ANPR, or was there a windscreen PCN?
          & did you have to get a ticket to display?

            ANPR and no need for a ticket because it’s free parking. Just only for customers and with an hour and a half maximum. Thanks for your help. Will post paperwork now.

                          As I thought, pretty compliant for the purposes of PoFA 2012.
                          However, ANPR capture does not measure the actual parking time, only the times between entering & exiting.
                          They have to allow a 'reasonable' grace period at the beginning of the parking event (to find a space, read the sign etc.) plus an extra 10 minutes minimum to exit.
                          How old is the baby?

                            17months at the time actually. And it would have taken me a while to get him into the car seat while trying to keep him asleep if that helps.

                              I was wondering whether the 'maternity' provisions of the Equality Act might kick in, but 17 months is probably outside of that.

                              Even so, the 'reasonable period' allowed at the beginning of the parking event should reflect the circumstances at the time (extra time needed for pram? etc etc), plus a similar adjustment made for the minimum 10 mins grace period to exit.
                              Nappy changes wait for no-one, lol!
