I have now been hit with a Council Tax Liability Order even though I have paid every month by telephone banking the sum due for each month. We advised the council prior to the hearing that we would not be able to attend as we where on a pre booked holiday out of the country at the time of the hearing. We also advised them that as each payment we made actually covered 36.5 days our payments where actually in advance and they should amend there computer records to accurately reflect the payments made. As of the hearing date on the 24th August 2015 we had made 5 payments of 36.5 days which equals 182.5 days whereas 24th August is only 146 days so 36.5 days in credit. How can they get away with this there also now charging £75.00 costs as well.

With regard to the amounts you should have been advised what each payment was, you can't just decide the amount.
Sorry to be so negative but that just reflects my experience.

Re: Council tax rules re 10 annual payments.
Don't most CT bills have a date of payment on them (I know mine does)? If you didn't pay the payments on or before the dates specified on the bill then it'd show up on the council's database as in arrears

you can (however) usually arrange with the council to pay your CT over 12 months instead of 12 ... maybe you can have a word with them about it?Debt is like any other trap, easy enough to get into, but hard enough to get out of.

But the council determine both the payment amount & dates.
You can't say that each payment is so many days worth on such a such date.

Re: Council tax rules re 10 annual payments.
Council Tax is payable in full on 1 April each year. As a dispensation you may be allowed to pay in monthly instalments and payment may be made on varying dates but you must agree this with the Council first otherwise payment must be made by the first of each month. As we are into September you should have made 6 payments so far, it does not matter if you pay more that what is owed.
Unfortunately you have found out the hard way how this happens and there is not much you can do about. You may make complaint but I'm afraid they will point out what I have said above. One way of trying to mitigate it is to speak to your local Councillor(s) and ask if they will intervene on your behalf.
As a LO has been obtained the Council will be looking for the rest of the years payment in full and unless you can address this will hand it to Bailiffs to enforce - this of course comes with added costs.

Re: Council tax rules re 10 annual payments.
But did you pay the amount they said was due (on the CT bill) for each installment, or did you just divide the total by 12 and pay that?
To have a 12mth time period to pay a CT bill (instead of the usual 10) you would have needed to arrange it with your council in advance.Debt is like any other trap, easy enough to get into, but hard enough to get out of.
