  • Council Tax Liabilty order dated from 2004

    Further to my previous post about dealings with North Somerset and their lovely recovery department, my other half has now recived another letter from JBW regarding a different previous address and a council tax bill dating back to 2002!

    Again no record of any chaser letters or even a summons or any corrospendence. have contact North Somerset once again asking for a breakdown of the bill, copy of corrospendence issued etc and asked them why only now after nearly 10 year have they decided to pursue this, when they have had my partners previous address on file, and have confirmed that held her previous address as they bill her for council tax at that address and issued a liability order to her relating to that address

    My Partner is convinced she paid the bill at the address as her father borrowed the money for her to pay it after her and her previous partner spilt and he walked out on her and left all the bills behind

    my questions is, i assume that the status barred statue dosen't apply as they have the liabilty order already and these things have no expiry date once rubber stamped?

    Will the council still have recordes dating back to 2002? (thinking under the Data protection act most records are destoried after six years)

    any advice and pointers would be great, love these fourms, so very helpful and informative

    Hi there

    Email the local council collections manager. Ask them to provide trhe full account and charges listing from the date. Also, get them, to ask any baillif they used at the time to provide you with any listings of what the collected.

    As well as a request, mark this as a complaint to the head of revenues.

    State in the complaint, that you think it was paid, they have not dealt with it correctly, and your concerned that whatever the circumstances, you would not hold the records you need to defend this due to the conduct so far.
