Re: how to appeal an overpayment

You would have to add that. I have used the above with success against HMRC and a major company in the not too distant past. HMRC complied and even included phone calls. The company was a different proposition and had to drag them through the Courts before they complied fully.

letter offer of repayment of overpayment of ctax benefit

We have an overpayment of £3487. We were going to appeal, but have been advised against it, so we have to pay.

I was going to send this:

          Dear Mrs ?

Following your letter of 21st February regarding the overpayment of £x, I would like to make an offer to repayment of £x a week.

This would be added onto the 14-15 bill, which I would like to pay in installments over 52 weeks if possible.

The money would be paid monthly by direct debit,/standing order on the 31st of every month, beginning on 31st March 2014.

Please advise me as soon as possible if this arrangement is acceptable.

          Yours etc etc

Does this sound ok? Thank you in advance.

Hi and welcome, It looks ok to me someone else may say different, I would say do not offer to pay more than you can comfortably afford.

Do we have any background to the council tax benefit overpayment?

                Ah http://www.legalbeagles.info/forums/...530#post409530

                Will merge threads. (edit: DONE)

So who has advised not to appeal ?

and have you had a response to your SAR yet?

Re: letter offer of repayment of overpayment of ctax benefit

No, there was no records printed, just a sentance in the long letter that said they had looked through the records and there was no evidence we had called or written to them.

                    In your first post
Then we were notified that we were entitled to a c tax reduction.
Were you informed that in writing ?

You have this evidence in writing are they denying it?

I'm just wondering if on that letter it says something like 'further to your telephone call informing us of change in circs' or something (I know most CTB letters are just template crap so may be not but worth a punt)

Also, I'm not entirely sure from what you said, did you actually send the SAR ?

Yes, we've sent the SAR request and the £10 fee. Just waiting for an outcome for that.

Good. Tell them you are looking into the situation and have sent a SAR and to hold the account pending that.

Also, who told you not to appeal?
