  • 3 Court summons, none recieved till after hearing.

    Hello,

    Will try to make a long story short. I was unaware that i needed to pay non domestic rates for a studio i rent, i was under the impression that the land lord was covering it along with the water (turns out i was wrong) and was also unaware that i was receiving post at this premises as it was not passed on by the landlord. Unfortunately this means i did not receive the reminders, warnings, 3 court summons and 2 notice of liability order. Late last week i returned to the premises to find a years worth of mail from the council and the courts along with a note from a bailiff dated for the previous day.

    Im not even sure where to start in an effort of making heads and tails of this, in the various letters the same figure is rarely mentioned twice, some are addressed to another studio here that i rented for a short period prior to moving over to this one, the two most recent court summons are for the same account but different figures and dated within a month of each other. The figures demanded for the previous premises relate to the whole year and not the period i was renting the property. The bailiffs letter only references only the most recent case.

    I could financially cover what is due to the council (and would quite happily do this as promptly as possible), but with all the additional court and bailiff fees, on top of the demand for the full 2012/13 rates to be paid on the current premises as well as the the additional fees being demanded for time i wasn't renting the former premises is becoming a very serious cost i could not possibly afford.

    So i guess my first question is where do i start trying to address this? Can i get out of the court fees? Bailiff fees? Is it possible to get a new hearing? Or even settle this with the council? Is my land lord culpable for not passing on my mail?

    What sort of tenancy did you have in respect of the studio? Also, when you say "studio" is it a studio in the sense of a workspace or a studio in the sense of living accommodation?

      Hi bluebottle, thanks for the reply.
      Its a commercial letting but only on a 1 year non renewable agreement, a studio in the sense of a workspace, hence the non domestic rates involved.
