    Hi All,

    Attached is a response to a FOI request where I have Arun Councils head of revenues confirming the overcharging of illegal levies to a large number of people.(after a heafty battle with them several months ago)My question as I am unsure of the form 5 procedure or any other court rules is there any course of action that can be taken after an open admittance of illegal overcharging .The bailiff concerned was directly employed by the council ie certificated employer was Arun council.

    Very interesting indeed, not many would readily hold their hands up to overcharging. Did you not think to ask what disciplinary action - if any - was taken against those who did this and was their more than 1 person involved.

    The Form 5 procedure is for those who employ Bailiffs to notify the County Court where the Bailiff was Certificated or even his employer of their dissatisafaction of their fitness. The Form 4 route is for the aggrieved party to do likewise. As this is the Council and information provided under the FOI I would be more inclined to let the local media handle it.

      There was a case, a few years ago, where my local authority illegally charged tenants for servicing the gas appliances in their homes. They admitted this in writing and paid the money back.

      In your case, as the bailiff is directly-employed by Arun Council, you need to speak to their Finance Department about them reimbursing you with the illegal charges and any other costs you have incurred as a result. All due credit to Arun Council for their response.
